Family trusts are a popular and effective way of managing and protecting family wealth for the present and the future. However, without proper succession planning, your client’s family trust could become a source of conflict, confusion and costly litigation after their death.

Succession planning for a family trust involves considering who will control the trust when the existing Appointor/Guardian dies or is unable to act due to some other incapacity. In some trust deeds, even insolvency can trigger the removal of the trust’s Appointor/Guardian. By planning ahead, you can ensure that the family trust continues to serve your client’s intended purposes. Careful consideration of who holds the Appointor role in a family trust and what happens when they can no longer act is of paramount importance when reviewing your client’s estate planning and business structuring requirements.
