SMSF - Update Rules

This kit provides you with all the formalities to update the Rules of a
Self-Managed Superannuation Fund (SMSF) that is compliant with the Superannuation Industry (Supervision) Act 1993.

The kit contains:

1. A SMSF Deed of Variation and updated Rules of the Fund,
2. Various minutes of the trustee/s meeting,
3. Product Disclosure Statement (PDS),
4. Investment Strategy, and
5. Register of Members, Member Application and Death Benefit Nomination (if applicable).
   

Why Update my SMSF rules?

There are a number of reasons why it can be appropriate to update the rules of a SMSF, some of these include:

• Many professionals that will work with the SMSF feel more confident with rules that are more recent,
• Changes in law can provide broader *or* more narrow options that are appropriate to be reflected in rules and allow the reader to be more up to date with the SMSF,
• New ways of thinking in managing, investing and planning SMSF’s require new more recent rules,
• Modernising rules can enable the members and the trustee to directly tailor aspects of their SMSF for them.

• What is your Super Fund's name?

  Please enter the full name of your SMSF. Do not put "the" before or "Fund" after the name of your Super Fund.
  
  For example:
  
  "John Smith Superannuation" for John Smith Superannuation Fund
  
  "Nicholson Family Superannuation Trust" for Nicholson Family Superannuation Trust Fund
  
  "Hutton-Grieve Super" for Hutton-Grieve Super Fund
  
  Usually, you can find the full name of your SMSF on the title page of your SMSF deed, on the front page of the deed or at the back in the Schedule to your SMSF deed.

  So that the minutes of meeting can be formally prepared we commonly identify the place of the meeting to be the usual place of address of the SMSF. This is why we need a physical address, not a Post Office Box number.
  
  The address could be your home or office or perhaps the office address of your accountant or adviser. Please identify what is practical for you.

• What address should I use?

  A single address is required in the Trust Deed and will serve as the address of the Fund for all trustees.
  
  The address provided in the Trust Deed is not recorded anywhere else.
  
  The individual contact addresses for each Trustee may be required upon registering your SMSF with the Australian Taxation Office. You may also provide the addresses of your professional advisers on your Australian Taxation Office registration forms who may receive notices on your behalf if you choose.

• Trustee Company ACN

  Please enter the ACN (Australian Company Number) of the company that is the trustee of your SMSF.
  
  Every Australian company has an ACN. It is a unique 9-digit number. If you are not sure what the trustee company’s ACN is, you can do a search for the ACN (if you know the company name) at www.asic.gov.au.
  
  Please do not put any spaces between the numbers, or any brackets. Just put in the numbers in the order that they appear in the company ACN.
